These Terms and Conditions govern the use of www.tiercooling.com and the purchase of TierCooling products — evaporative air coolers, HVLS industrial ceiling fans, low-carbon air conditioners and related systems. By using this website, requesting a quotation, or placing an order with TierCooling (“we”, “us”), you accept these terms.
1. About Our Products
TierCooling supplies industrial and commercial cooling equipment for factories, workshops, warehouses, logistics centers, gyms, exhibition halls and other large spaces. Product photographs are illustrative; colours and minor details may vary. Specifications are continuously improved and may be updated without notice; the specification confirmed in your quotation or Proforma Invoice applies to your order.
2. Quotations and Orders
Our business model is quotation-based: most orders are project, distributor or bulk orders confirmed by Proforma Invoice (PI).
- Quotations are normally valid for 30 days unless a different validity is stated.
- An order is binding once the PI is confirmed in writing and the agreed deposit is received.
- Technical requirements (voltage, frequency, plug type, ducting, OEM branding) must be confirmed before production starts.
3. Pricing and Payment
- Prices are quoted in USD unless otherwise agreed in writing.
- Payment terms follow each Proforma Invoice — typically T/T with a deposit on order confirmation and the balance before shipment.
- Bank charges outside China are borne by the buyer.
- Ownership of the goods passes to the buyer only after full payment is received.
4. Production and Delivery
Lead times start from receipt of the deposit and confirmation of all technical details. Stated lead times and delivery dates are good-faith estimates. Delays caused by port congestion, shipping-line schedules, extreme weather, power restrictions, epidemics or other force majeure events are not a breach of these terms; we will always notify you promptly and agree on a revised schedule.
5. Shipping, Risk and Customs
- Shipments are made under the Incoterm stated on the PI (for example EXW, FOB or CIF).
- Risk passes according to the agreed Incoterm; for buyer-arranged transport, risk passes when goods are handed to the carrier at the named port or factory.
- The buyer is responsible for import clearance, duties, taxes and compliance with local regulations in the destination country.
6. Inspection on Receipt
Please inspect quantities and external condition against the packing list when the goods arrive. Report any visible damage or shortage within 7 days with photographs (see our Returns & Refunds policy). Claims made after this window may be limited where carrier liability has expired.
7. Warranty
TierCooling equipment carries a 12-month limited warranty against manufacturing defects from the bill-of-lading date. During the warranty period we provide free spare parts together with video installation guidance, or other remedies described in our Returns & Refunds policy. The warranty excludes: incorrect installation or wiring, wrong local voltage, lack of maintenance, unauthorised modification or repair, accident or misuse, and consumable parts such as cooling pads and filters.
8. Intellectual Property
The TierCooling name, logo, website content, product photography and technical literature remain our property. OEM and private-label rights are granted only under a separate written agreement. Certification and test documentation (CRAA, ISO 9001, CE-related reports) is available to qualified buyers on request.
9. Limitation of Liability
To the maximum extent permitted by law, our liability under any order is limited to the invoice value of the goods concerned. We are not liable for indirect or consequential losses such as production downtime, loss of profit or third-party claims. Nothing in these terms limits liability that cannot be limited by applicable law.
10. Governing Law and Disputes
These terms are governed by the laws of the People’s Republic of China. Disputes are settled primarily through friendly negotiation; if negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration.
11. Changes to These Terms
We may update these terms from time to time. The version published on this page at the time of your quotation or order applies to that transaction.
